2. Terms, acknowledgment, acceptance, and modifications. Pre-Contractual information

These Terms define the rights and obligations of the parties involved: KNOWTRANSFER SL and the USER of the Website.

The USER acknowledges and accepts these Terms, agreeing that they represent the entire agreement between them and KNOWTRANSFER SL, with no need for any additional written documentation. Each clause is independent and stands alone. KNOWTRANSFER SL reserves the right to modify these Terms at any time, without prior notice, including the addition, removal, or modification of content and services. The USER’s continued use of the website implies acceptance of these Terms as they are, each time they use the service.

Before proceeding with any purchase, and throughout the purchasing process, the Customer will have access to, and may print or save, these General Terms and Conditions for future reference.

All personal information provided by the Customer when using this website will be handled in accordance with KNOWTRANSFER SL’s Privacy Policy and in compliance with applicable laws, as outlined in these Purchase Terms and in line with the preferences the Customer selected when accepting these Terms. The Customer confirms that all the information provided is accurate and truthful. Failure to provide the required information will prevent the order from being processed. The Customer agrees not to place any fraudulent or false orders. In such cases, KNOWTRANSFER SL reserves the right to cancel the order and take any necessary actions. The Customer affirms that they are over 18 years old and have the legal capacity necessary to enter into binding financial contracts. In the case of legal entities, individuals acting on behalf of the entity through this website guarantee that they have the proper legal authority to represent the entity at the time of the transaction. They also guarantee that the transaction does not violate any third-party rights and that the information provided about the legal entity is truthful, accurate, and reliable. KNOWTRANSFER SL will not be held liable for any damages, losses, or injuries to persons or property arising from or related to the above declarations.

 

3. Products

The Customer acknowledges that all products sold by KNOWTRANSFER SL are intended for domestic use and have undergone testing in accordance with applicable standards and regulations. However, some items in the product range have been tested for professional or public use and meet the necessary safety, durability, and stability requirements for those specific applications. KNOWTRANSFER SL’s warranties for its products are generally based on their intended domestic use. Before purchasing any item, the Customer must ensure that it is suitable for the intended purpose. KNOWTRANSFER SL will not be held liable for any claims arising from the use of a product for any purpose other than its intended use.

 

4. Online services. Product delivery

On our website, USERS can find various delivery options. Product pages include all necessary details regarding the size and volume of our items.

The product will be delivered by courier directly to the address provided by the customer. If the customer is not home, the product will be left at the building’s reception desk, if applicable. This delivery policy also applies to returns.

If, upon receiving the product, the CUSTOMER notices any damage, such as dents, breaks, signs of tampering, or any other defects, they must immediately contact KNOWTRANSFER SL via email at protecciondedatos@4uabogados.com or through any other communication channels available on our website (https://knowtransfer.com/). The notification should include the reason for the issue, the invoice number, and, if possible, the delivery receipt. This will help us inform the delivery company about the problem. If the shipment is returned to KNOWTRANSFER SL due to an error on the CUSTOMER’s part, such as providing an incorrect address or failing to pick up the package, the shipping costs incurred will not be refunded.

4.1 Shipping conditions

We will handle all deliveries through a professional courier service. Once we confirm your order, you can expect delivery within a maximum of 5 business days.

Typically, deliveries from KNOWTRANSFER SL are completed within 3 to 5 days after the order is finalized.

These delivery times are estimates and may vary due to logistical issues or unforeseen circumstances. If any delays occur, KNOWTRANSFER SL will notify you as soon as we are informed. A delivery is considered completed once the courier service makes the product available to the Customer, as confirmed by the tracking system used by the delivery company. If the delay is due to an issue on our side, the Customer has the option to cancel their order, as outlined in the "Returns" section. Delays caused by circumstances where the courier has made the product available within the agreed timeframe but could not deliver it due to a mistake by the Customer are not considered delays.

Once the order leaves our warehouse, you will receive an email confirming that your order is on its way.

Please note that if you wish to cancel the order after it has been dispatched, the shipping costs will not be refunded.

KNOWTRANSFER SL will not be held responsible for delays caused by force majeure events (such as strikes or natural disasters) that may impact delivery timelines.

 

5. Price and payment. Invoicing

The prices of products listed on our website are exclusive of VAT and reflect the current rates at the time of purchase, including any applicable promotions or discounts.

Service fees are not included in the product price and will be added to the total amount before payment is processed. Upon order confirmation, the Customer will receive an electronic invoice via email, detailing the products and services purchased.

 

6. Cancellation, withdrawal, and returns

6.1. Right of withdrawal

Upon receipt of the goods, the Customer, if considered a consumer, has 14 calendar days from the delivery of the last product in a single order to exercise their right of withdrawal, either partially or in full. In the event of withdrawal, whether in full or in part, KNOWTRANSFER SL will refund the Customer using the same payment method initially used for the purchase. This will cover the amount paid for the returned goods and any contracted services (such as collection or delivery services), with the refund being proportional to the quantity of goods returned. The refund will be processed within a maximum of three business days from the moment KNOWTRANSFER SL receives the returned goods.

 

To exercise the right of withdrawal, the Customer must contact KNOWTRANSFER SL within the given time frame by sending an email to protecciondedatos@4uabogados.com, requesting a withdrawal form, which the Customer may choose to use or not. Alternatively, the Customer may submit the withdrawal form via email to protecciondedatos@4uabogados.com

If the Customer opts for KNOWTRANSFER SL to collect the items, the return costs will be the responsibility of the Customer. These costs will be deducted from the total refund amount. In such cases, the full price will be refunded using the same payment method as the original transaction. Partial cancellations are not accepted. The Customer must cancel the entire order and place a new one. After this period, KNOWTRANSFER SL cannot guarantee that the order has not already left our warehouse. If that is the case, the transportation costs previously paid will be deducted from the refund.

 

6.2. Returns

At KNOWTRANSFER SL, we are confident that you will be satisfied with your purchase. However, if for any reason you are not, we accept returns within 30 calendar days of receiving your order. Please note that the Customer will be responsible for covering the return shipping costs. The item must be returned in its original condition, including the packaging, contents, and any accessories, all of which must be in perfect condition, along with the original invoice. We cannot accept returns if the packaging has been tampered with or if the product and/or its accessories are damaged.

 

6.3. Cancellations

The customer may cancel orders for standard catalog products at any time before the selection or packaging for shipment. KNOWTRANSFER SL reserves the right to refuse cancellations for customized products, out-of-stock items, or non-inventoried products. In such cases, cancellation may incur additional fees. If you wish to cancel an order, please contact our customer service representative.

 

7. Legal warranty

KNOWTRANSFER SL is fully committed to complying with all relevant laws, particularly those related to consumer protection. Therefore, the CLIENT is informed that, as required by law, KNOWTRANSFER SL guarantees its products for a period of 6 months

Within this period, the CLIENT has the right to report any issues of non-compliance with the product, specifying the reason for their dissatisfaction. A common example of non-compliance would be a defect in the product. Once the non-compliance is confirmed and addressed in line with these policies and the applicable regulations, KNOWTRANSFER SL will take the appropriate actions based on the circumstances. Non-compliance resulting from improper use, incorrect installation, or any other issues caused directly or indirectly by the CLIENT, or by external factors beyond the company’s control, will not be covered by this warranty.

The Customer agrees not to submit any false or fraudulent orders. KNOWTRANSFER SL reserves the right to cancel such orders and take appropriate action where necessary.

The Customer confirms they are at least 18 years old and have the legal capacity to enter into binding agreements.

For corporate entities, individuals acting on their behalf via this website guarantee both to KNOWTRANSFER SL and to any third parties involved in delivering the contracted services that they hold the necessary authorization from the corporate entity at the time of purchase. They further confirm that the transaction does not infringe upon the rights of any third party and that all information provided regarding the corporate entity is truthful, accurate, and reliable.

3. Consumer and user status

4. Legal warranty

KNOWTRANSFER SL is firmly committed to adhering to all applicable laws, with a particular focus on consumer protection. For this reason, the CLIENT is informed that, in compliance with current regulations, the manufacturer provides a 6-month warranty on its products. It is important to note that KNOWTRANSFER acts exclusively as a reseller.

Within this period, the CLIENT has the right to report any issues of non-compliance with the product, specifying the reason for their dissatisfaction. A common example of non-compliance would be a defect in the product.

Once the non-compliance is confirmed and addressed in line with these policies and the applicable regulations, KNOWTRANSFER SL will take the appropriate actions based on the circumstances.

Non-compliance resulting from improper use, incorrect installation, or any other issues caused directly or indirectly by the CLIENT, or by external factors beyond the company’s control, will not be covered by this warranty.

 

5. Replacement and repair

In the event that a product is found to be non-compliant, the CLIENT has the option to choose between a replacement or repair. However, since KNOWTRANSFER SL does not offer an in- house repair service, if the CLIENT opts for repair, KNOWTRANSFER SL will refer them to the manufacturer’s or importer’s authorized repair service.

If the manufacturer or importer does not provide this service, or if the cost of using it would be excessive for the CLIENT, the product will be replaced with a new one. In any case, KNOWTRANSFER SL may choose to replace the product if the repair costs are deemed disproportionate.

The replacement will be with a product identical to the one originally purchased. If the item is out of stock, KNOWTRANSFER SL will offer the CLIENT an equivalent replacement, ensuring it has the same specifications and price as the original product.

KNOWTRANSFER SL will cover all shipping and handling costs associated with the replacement or repair. The CLIENT will receive a new or repaired product at no additional cost.

 

6. Process for requesting product conformity

If the CLIENT identifies a non-conformity with their product, they must promptly contact KNOWRANSFER SL at the following email address: protecciondedatos@4uabogados.com

 In their message, the CLIENT must include the following information, which must be accurate and up to date:

 

• Full name and ID number of the person who placed the order

• Order identification (product purchased, date, and, if possible, any supporting documents)

• The reason for the non-conformity (e.g., product defect), with as much detail as possible

• Whether they prefer a replacement or a repair

• Shipping address for the order

• Date of purchase

 

The CLIENT must provide sufficient evidence of the product’s non-conformity and clarify any details or circumstances that KNOWTRANSFER SL considers necessary to determine whether the warranty rights apply.

KNOWTRANSFER SL may contact the CLIENT as needed to gather additional information or clarify any facts necessary to process the request. However, KNOWTRANSFER SL commits to doing so as quickly as possible and within a reasonable timeframe.

Once the information is reviewed, KNOWTRANSFER SL will inform the CLIENT whether the warranty applies. The CLIENT will also be notified about whether the product will be repaired or replaced, depending on the circumstances.

Following this, KNOWTRANSFER SL will handle the collection of the product and the delivery of either a new or repaired product at no additional cost to the CLIENT.

 

7. Data protection

The processing of personal data in connection with this Warranty and Return Policy will be carried out to comply with the legal obligations outlined in Articles 114 and following of the LGDCU, as well as to fulfill the terms of these policies. By exercising the warranty right, regardless of whether it is deemed applicable or not, the CLIENT gives explicit consent for their personal data to be processed for the specific purpose outlined. KNOWTRANSFERL SL, with Tax Identification Code B19918697, will be responsible for processing your personal data.

KNOWTRANSFER SL will not use your data for any purposes other than those mentioned here. However, it is possible that in the future, data may be collected for statistical purposes, but in such cases, no personal data will be included. KNOWTRANSFER SL will not share your data with third parties, unless an external party is involved in providing repair services, solely for the purpose of fulfilling the objectives described above. In this case, the CLIENT will be informed about the data transfer.

Any legal matters involving KNOWTRANSFER SL will be governed by Spanish law, and the competent courts and tribunals will be those located in the region where KNOWTRANSFER SL is based in Spain.
